Old Property Deeds

All properties in England and Wales are now subject to compulsory registration with the Land Registry, which means that when a person purchases a property either he or his conveyancer must apply to the Land Registry to effect registration. The Land Registry then produce a Title Register and Title Plan, which are held electronically at their offices. They contain all the essential ownership and property details. Under the old pre-registration system most property transactions were recorded in handwritten or typed deeds. Although useful, these documents are no longer used as a means of recording ownership or property details.

These Old Deeds often contain useful information about boundaries, covenants and rights of way, and frequently have detailed plans and drawings attached to them. Accordingly they still provide a useful purpose in land ownership information.

These comprise copies of any old deeds of conveyance, transfers, indentures, agreements, illustrative plans, epitomies, abstracts of title, licences and wayleave agreements that the Land Registry have filed with the Title Register. They are usually documents once used in the old pre-registration conveyancing process and do not constitute the main title documents. Their main value is their more detailed descriptions of covenants, easements and agreements contained within them.
